First 72 Hours

What to do after
a California truck crash.

Truck cases have a hard preservation clock. The carrier's data, dash cams, and logs can be overwritten within days. These seven steps protect both your health and the evidence.

  1. 01

Call 911 and get medical care first.

Truck crashes produce serious injuries that may not surface until hours later. An ER visit creates the medical record your case will lean on for the next 18 months.

  2. 02

Photograph the scene from multiple angles - including the truck's DOT number.

The USDOT number painted on the cab is your key to identifying the carrier. Photograph the trailer numbers, hazmat placards, license plate, and the visible damage from multiple angles.

  3. 03

Do not let the truck be moved before photos.

Final rest positions, debris fields, and skid marks are the inputs an accident reconstructionist needs. If you can wait for CHP, do.

  4. 04

Get each witness's name and phone.

Truck crashes draw witnesses. Their accounts are often the difference between a contested-liability case and a clean one.

  5. 05

Do not give the trucking company a recorded statement.

Carrier-side insurance adjusters will call within 24 hours. You are not required to give a recorded statement. Decline and call a lawyer first.

  6. 06

Save each paper, prescription, and receipt.

Towing invoices, rental cars, mileage to medical appointments, missed-work records, photos of bruises and scars as they evolve.

  7. 07

Call a Devoted attorney within 7 days.

We send a written preservation letter to the carrier the same day, demanding retention of ELD data, driver logs, dash-cam video, maintenance records, and post-crash drug-test results. Without that letter, the evidence is often gone.

Preserve the FMCSA evidence before it's overwritten.

ELD data, driver logs, and dash-cam footage are routinely overwritten within 7 days. A written preservation letter on day one is one of the cheapest things you can do to protect a truck case.

Law That Applies

Federal rules + California statutes
work together.

Federal Trucking Rules

49 CFR Parts 350–399 - FMCSA Regulations.

primary source →
The Federal Motor Carrier Safety Regulations cover hours-of-service, ELD data, driver qualification, vehicle inspection, maintenance, and post-crash drug and alcohol testing. Violations are routinely the cornerstone of liability in trucking cases.
Statute of Limitations

CCP § 335.1 - Two years to file.

primary source →
Two years from the date of the crash to file. If a public entity is involved, six months for a notice of claim under Gov. Code § 911.2.
Vicarious Liability

Civ. Code § 2338 + Respondeat Superior.

primary source →
California holds employers liable for the negligent acts of employees within the scope of employment. For commercial trucks, the FMCSA's statutory-employer rule typically extends liability to the motor carrier whose authority the driver was operating under.
Tort Damages

Civ. Code § 3333 - Full compensation.

primary source →
Detriment proximately caused by the wrong. Economic + non-economic damages. Punitive damages are available where conduct was malicious, oppressive, or fraudulent (Civ. Code § 3294) - which arises in trucking when records show carrier-level disregard for safety rules.
Compensation You May Recover

Truck case damages
are typically larger.

Commercial trucks carry $750k–$1M+ liability policies, often layered with excess coverage. Past results do not guarantee a similar outcome.

Economic Damages
  • Emergency, hospital, surgical, and rehab costs
  • Long-term and life-care planning for catastrophic injury
  • Lost wages and lost earning capacity
  • Vehicle replacement and personal property
  • Future medical care, equipment, and home modifications
  • Out-of-pocket transportation and care costs
Non-Economic Damages
  • Pain and suffering (physical and emotional)
  • Mental anguish, anxiety, and PTSD
  • Loss of enjoyment of life
  • Disfigurement and scarring
  • Loss of consortium (spouse / partner)
  • Punitive damages where carrier conduct supports it (Civ. Code § 3294)

Past results disclaimer. Prior results do not guarantee, warrant, or predict a similar outcome in your case.

Common Causes

Why California truck crashes happen.

  • Hours-of-service violations
    Drivers exceeding the 11-hour daily / 70-hour weekly limits under 49 CFR § 395.
  • Driver fatigue and falsified logs
ELD data and dispatch records often expose the gap between the log and the trip.
  • Improper loading and shifting cargo
Cargo loaders are separate defendants under California law.
  • Brake, tire, and maintenance failures
FMCSA inspection records reveal whether the carrier deferred safety-critical work.
  • Distracted driving (texting, dispatch device)
Phone records subpoenaed during litigation routinely break a case open.
  • Inadequate driver training and hiring
Negligent-hiring claims when the carrier missed a problematic record.
  • Speeding and aggressive driving
ECM 'black box' data shows speed in the seconds before impact.
Common Injuries

What we see most often.

  • Traumatic brain injury
Closed-head injuries are common even at moderate speeds when a 40-ton vehicle is involved.
  • Spinal cord injury and paralysis
Catastrophic, often requires a life-care plan and future-medical projection.
  • Multiple-bone fractures
Crush injuries to the legs, pelvis, and chest.
  • Internal organ damage
Often discovered hours later on second-look imaging.
  • Severe burns
Especially in fuel-fire cases. May involve a truck manufacturer.
  • Amputations
From crush mechanism or post-injury surgical necessity.
  • Wrongful death
California gives surviving family two years from the date of death to bring a claim.
California Trucking Corridors

The corridors
where most truck cases start.

Most California commercial truck traffic concentrates on a handful of corridors - the I-5 spine from the border to Redding, I-10 east through the Inland Empire, I-15 to Las Vegas, I-80 through the Bay Area, and I-710 north out of the ports of Long Beach and Los Angeles. According to the FMCSA Large Truck and Bus Crash Facts, California consistently leads the nation in commercial-vehicle crashes by volume. We handle cases on each of these corridors and across the state.

Truck Accident FAQ

California truck crash questions, answered.

How long do I have to file a truck accident claim in California?
+
Two years from the date of the crash under CCP § 335.1. If a public entity is involved (a state vehicle, a poorly maintained highway, a municipal truck), you need to serve a notice of claim within six months under Gov. Code § 911.2. Trucking cases also involve federal preservation obligations - evidence requests should go out within days.
Who can be sued after a California commercial truck accident?
+
Often more than just the driver. Potential defendants include the trucking company (under respondeat superior and negligent-hiring theories), the truck owner if separate, the cargo loader, the maintenance contractor, and sometimes a manufacturer if a part failed. Multiple defendants usually mean multiple insurance policies.
What federal rules apply to California truck cases?
+
Commercial trucks above 10,001 lbs are governed by the Federal Motor Carrier Safety Regulations (49 CFR Parts 350–399) administered by the FMCSA. These cover hours of service, drug and alcohol testing, driver qualification, vehicle maintenance, and electronic logging device (ELD) data. Violations are often the cornerstone of a strong truck case.
How is a truck accident case different from a regular car accident?
+
Higher stakes, more parties, more evidence, and a hard preservation clock. ELD data, driver logs, dash-cam video, and maintenance records can be overwritten within days unless a written preservation letter goes out. Insurance limits are typically $750,000 to $1M+ rather than a state minimum policy. Liability is often multi-layered.
What if the truck driver caused the crash but worked for a national carrier?
+
Under California's respondeat superior doctrine and the FMCSA's statutory-employer rule, the carrier is usually liable for a driver acting within the scope of employment. We handle out-of-state corporate defendants regularly - California courts have jurisdiction over carriers doing business in the state.
What kinds of compensation can I recover after a California truck crash?
+
Economic damages (medical bills past and future, lost wages, lost earning capacity, vehicle damage, life-care plan costs for catastrophic injuries) and non-economic damages (pain and suffering, emotional distress, loss of consortium). Civ. Code § 3333 governs the measure of damages. Past results do not guarantee a similar outcome.
Does Devoted handle wrongful-death cases from a truck crash?
+
Yes. California wrongful-death claims need to be filed within two years of the date of death under CCP § 335.1. Survivors and certain other relatives may bring the claim. Trucking-related wrongful-death cases often involve federal regulatory violations as the core liability evidence.
How much does it cost to hire a Devoted truck accident attorney?
+
We work on a contingency fee basis. You pay nothing upfront, and we only get paid if we win your case.
