What to do
after a California skateboarding crash.

Skateboarding cases come in three shapes - hit by a car, fell because of a road or premises defect, or the equipment failed. Each requires different evidence. Each needs fast action.

    Call 911 - get medical care and a police report.

    Head, wrist, and shoulder injuries are the most common in skateboarding crashes. The police report locks in the location, time, and any third party involved.

    If a vehicle was involved: get the driver's information.

    Name, license, plate, insurance. Photograph the cards. Get each witness's name and phone before they leave the scene.

    Photograph the scene, the hazard, and the board.

    Pavement crack, sidewalk lift, manhole edge, debris, oil - whatever caused or contributed to the fall. Photograph the board and trucks from multiple angles, especially if equipment failure is suspected.

    Preserve the board, trucks, wheels, bearings, helmet, and gear.

    Do not repair, replace, or throw anything away. For equipment-failure or premises cases, the physical evidence is critical.

    Get witness names and phone numbers.

    Other skaters, drivers, store-front employees. Names captured at the scene matter more than statements weeks later.

    Get medical evaluation - full workup.

    Concussion, wrist fractures (FOOSH - fall on outstretched hand), shoulder injuries, and facial fractures often surface 24–72 hours later. ER documentation from day-of is the strongest medical evidence.

Skate Park Immunity

California shields public entities from most liability for hazardous recreational activities like skateboarding at public skate parks. Exceptions: gross negligence, willful misconduct, failure to warn of known dangers outside the activity's inherent risks. Private parks are governed by ordinary premises liability.
Dangerous Public Property

Gov. Code § 835 + § 911.2 (6-month notice).

Public entities are liable for dangerous conditions on public property if they had actual or constructive notice. A 6-month notice of claim needs to be served under § 911.2. Sidewalk defects, manhole edges, and unmaintained pavement are the most common claims.

California skateboarding-injury questions, answered.

Can I sue if I was hit by a car while skateboarding?
Yes. Skateboarders are treated as vulnerable road users in California, and a driver's duty of due care under Veh. Code § 22107 applies. The Vehicle Code does not require skateboarders to ride on sidewalks, but local ordinances vary. A driver who hit you owes the same duty they would to a pedestrian or cyclist.
Can I sue the city for a pavement defect or unsafe road?
Sometimes. Public entities are liable for dangerous conditions on public property under Gov. Code § 835 - but you need to serve a notice of claim within six months under Gov. Code § 911.2. The defect needs to be substantial, the entity needs to have had notice, and the injury needs to be foreseeable. The six-month clock is unforgiving.
What about skate parks? Can I sue if I'm hurt there?
Public skate parks are generally protected by California's hazardous-recreational-activity immunity (Gov. Code § 831.7), which bars most claims for ordinary risks of the activity. Exceptions exist for gross negligence, willful misconduct, or known dangerous conditions outside the activity's inherent risks. Private skate parks are governed by ordinary premises-liability law (Civ. Code § 1714).
How long do I have to file a skateboarding claim in California?
Two years from the date of the injury under CCP § 335.1. If a public entity is involved, you need to serve a notice of claim within six months under Gov. Code § 911.2. For minors, the statute is tolled until age 18 plus two years (CCP § 352).
My board broke mid-ride and I crashed. Do I have a claim?
Yes - a claim may exist against the manufacturer or seller. Strict-liability rules under Greenman v. Yuba Power Products (1963) may apply. Preserve the board, trucks, wheels, and bearings - do not throw them away. The physical evidence is critical.
Are helmets required in California?
Yes for riders under 18, under Veh. Code § 21212. Adults are not required to wear a helmet. Failure to wear one doesn't bar recovery, but it can reduce damages for head injuries under pure comparative negligence.
What kinds of compensation can I recover after a skateboarding crash?
Economic damages (medical bills past and future, lost wages, lost earning capacity, board/gear replacement) and non-economic damages (pain and suffering, emotional distress, loss of enjoyment, disfigurement). Civ. Code § 3333 governs. Past results do not guarantee a similar outcome.
