What to do
after a California e-scooter crash.

Scooter cases hinge on two pieces of evidence: the scooter's mechanical condition and the rental operator's maintenance records. Both can disappear or be reset within hours.

    Call 911 - police report + paramedics.

    Document the crash officially. The police report fixes the location, time, scooter ID (if visible on the rental sticker), and any other parties.

    Screenshot your rental app session.

    Trip ID, start time, end time, route. This is the rental operator's record-of-truth that they may not be able to delete later.

  3. 03

    Photograph the scooter - each angle.

    Damage from impact, brake lever position, throttle, wheels, tires, frame welds, and serial number. The scooter belongs to the operator; document the details before they collect it.

    Get the driver's information (if a vehicle was involved).

    Name, license, plate, insurance. Photograph the cards.

  5. 05

    Get each witness's name and phone.

    Other riders, drivers, pedestrians, store-front employees. Names captured at the scene matter more than statements weeks later.

    Get medical care, even if you feel okay.

    Scooter crashes often produce facial fractures, hand and wrist injuries, and concussion. ER documentation from day-of is the strongest medical evidence.

Riders need to be 16+, have a valid driver's license or learner's permit, ride in bike lanes or roads (no sidewalks), and yield to pedestrians. Helmets required under 18. Violations of these rules can be argued as comparative fault - but rarely bar recovery outright.

What are the rules for electric scooters in California?
California Vehicle Code § 21235 sets rider rules: you need to be 16 or older, have a valid driver's license or learner's permit, ride in bike lanes or roads (not on sidewalks), and yield to pedestrians. Helmets are required for riders under 18. The maximum speed for shared-rental e-scooters is capped at 15 mph by AB 2989.
Can I sue Bird, Lime, or another e-scooter company?
Yes - if the scooter was defective or improperly maintained. Rental operators have a duty to inspect, charge, and maintain their fleet. If a brake failed, the throttle stuck, the wheel locked, or the scooter had a known issue not yet repaired, the operator can be a defendant. Their app waivers do not bar most claims under California law.
How long do I have to file a scooter-accident claim in California?
Two years from the date of the crash under CCP § 335.1. If a public entity is involved (a city vehicle, a dangerous public road defect, a damaged sidewalk where the scooter was forced to ride), you need to serve a notice of claim within six months under Gov. Code § 911.2.
I was a pedestrian hit by an e-scooter - do I have a claim?
Yes. The rider is responsible for damages caused by negligent operation, just as a cyclist or driver would be. The scooter rental company may also be liable if the scooter was defective. If the rider fled, the rental operator's records can identify them through ride logs.
What if the scooter's brakes, throttle, or wheel failed mid-ride?
That may point to an equipment-defect claim against the manufacturer and/or rental operator. We pull serial numbers, recent maintenance logs (subpoena), and any prior-issue reports. Strict-liability rules under Greenman v. Yuba Power Products (1963) may apply.
What if the driver hit me while I was on the scooter?
Same framework as a bicycle case. The driver owes a duty of due care (Veh. Code § 22107 for lane changes, § 21950 in crosswalks). The Three Feet for Safety Act may not apply directly to scooters, but the underlying duty to drive safely around vulnerable road users does.
What kinds of compensation can I recover after a scooter crash?
