California Rule 1.5.1

How the division of fees works.

California Rule of Professional Conduct 1.5.1 allows lawyers in different firms to divide a contingency fee on a single client matter when (a) the client gives written consent at the time the agreement is made, (b) the total fee is not increased solely because of the division, and (c) the lawyers' written-fee-division agreement is made at the time of the referral.

In practice: when you send us a case, we set up a referral agreement that documents the percentage division, file the client-consent paperwork at engagement, and disburse the agreed-upon share at settlement or judgment.

If a case requires significant work from the referring attorney (co-counsel, depositions, motion practice), we negotiate that into the division up front. If the referring attorney is hands-off, the division reflects that as well.

Referral FAQ

Common questions, answered.

Do you pay a referral fee under California Rule 1.5.1?
+
Yes. We honor California Rule of Professional Conduct 1.5.1 referral arrangements with the client's written consent and proper division-of-fees agreement. The arrangement is documented before the referred case is accepted.
What case types do you accept referrals on?
+
Auto accidents (car, motorcycle, truck, rideshare, bicycle, pedestrian, e-bike, scooter, skateboarding), slip and fall, dog bites, and wrongful death - anywhere in California. We do not handle medical malpractice, dental malpractice, attorney malpractice, assault/battery, or product defect cases.
What is your fee structure?
+
Contingency: one-third (33⅓%) of the recovery if the case resolves before a lawsuit is filed, 40% if litigation is filed.
How fast can you take a referral?
+
Within 24 hours. Send the case details to intake@devotedlaw.com or call (888) 760-2529. A Devoted attorney calls back the same business day to discuss the referral and the engagement.
Do you accept out-of-California referrals?
+
We accept matters with California jurisdiction. If the case has California venue (where the injury happened or the defendant resides), we can take it from a referring attorney licensed anywhere.
Will the referring attorney stay informed?
+
Yes. We send updates at each major milestone - demand sent, suit filed, mediation date, settlement, disbursement. You stay in the loop without doing the day-to-day work.
